The other day we had our state legislator visit seeking our continued support. He advised us that even if TABOR passed, it is against the Maine Constitution; being that the Legislature cannot be overruled in matters such as this.
So the state would be off the hook and local municipalities would be obligated to fulfill the obligations of the bond issue. For example, everything in a town government would have to be voted on, and a three-quarters majority of the voters would decide the fate of a municipal budget.
Is this true? If so, then why isn’t this part of the discussion?
It would be nice to get some clarification from a Maine law professor on this issue.
