Bangor man indicted for invasion of home

BANGOR – The Penobscot County grand jury on Monday handed up a new series of charges against a Bangor man shot by police in April after allegedly attacking an officer with a wooden stake following a bizarre burglary on French Street.

Timothy Lever, 32, was indicted Monday on charges of burglary, assault and refusing to submit to arrest for an earlier incident in which he allegedly forced his way into a Coombs Street home and attacked the homeowner, according to Assistant District Attorney Alice Clifford.

In the Coombs Street incident, which occurred just three days before the French Street burglary, Lever reportedly forced his way into the home and choked the homeowner, who was home alone with his young son. It took five police officers to apprehend the 6-foot-2, 250-pound Lever after a lengthy struggle, according to reports.

Lever, who was transferred to the Penobscot County Jail last month after a three-month hospital stay, has already pleaded not guilty by reason of insanity to a series of charges from the French Street incident in which he broke into a family’s home and threatened the homeowner with a wooden stake.

Lever on Monday remained at the jail, unable to make his $5,000 cash bail.

In an earlier interview, Lever’s Bangor attorney, John Gause, said his client, who suffers from schizophrenia, was delusional at the time of the French Street invasion and actually believed he was helping people by his actions.

During that early morning burglary, Bangor Police Officer James Buckley shot Lever three times in the abdomen and arm when he charged out of the house swinging a 3-foot-long stake at responding officers.

The Attorney General’s Office later cleared Buckley, who had ordered Lever to drop the weapon.

Less than 24-hours before the shooting, a judge released Lever on bail after his arrest on the Coombs Street charges. The judge released Lever on the condition that he seek treatment for his mental illness.

The grand jury on Monday also handed up indictments against the following people:

A grand jury does not determine the guilt or innocence of a defendant, only if the state has enough evidence to go to trial.
