Student sues Colby over sexual assault finding

WATERVILLE – A Colby College senior who was found guilty by a campus disciplinary panel of sexually assaulting a female student has sued the Waterville school in a bid to clear his name and regain his scholarship.

Kevin Millien claimed that Colby violated its judicial procedures in the case.

“Colby has branded him as a sex offender and that is going to follow him academically, professionally and personally the rest of his life,” said his lawyer, Michaela Murphy of Waterville.

Colby spokesman Stephen Collins said the college maintains that Millien received a fair hearing and that its Student Disciplinary Procedures are sound.

A hearing on Millien’s request for a preliminary injunction is scheduled for Jan. 16 in Kennebec County Superior Court.

Meanwhile, Waterville police and the District Attorney’s Office are continuing an investigation to determine whether Millien should face criminal charges.

“We have worked with their detective division on this case and, as soon as it is complete, we will sit down with Waterville police and make a decision as to whether this case can go forward,” said Evert Fowle, district attorney for Kennebec and Somerset counties.

Murphy said the civil lawsuit against Colby contends that the college breached its contract with Millien in regard to how it handled its student disciplinary process.

Specifically, Murphy charges that the college failed to follow the guidelines outlined in its Student Handbook when it allowed the alleged victim to appeal the decision of the disciplinary board at the Waterville college that first made a ruling on the accusation.

Millien, who now is living with his mother and sister in New York, needs his scholarship in order to complete his senior year, his lawyer said.
